SEARCH & SEIZURE United States v. Martinez, No. 07-4040, ___ F.3d ___ (10th Cir. Jan. 15, 2008)(Utah). Appeal of conviction and sentence for possession of methamphetamine with intent to distribute in violation of 21 U.S.C. § 841(a)(1) and 18 U.S.C. § 2. HELD: Where Utah Highway Patrol officer observed vehicle with just one California license plate in violation of California two-plate requirement, officer had sufficient justification for initial traffic stop. Because traffic stop was justified at its inception, it was lawful and district court properly denied defendant’s motion to suppress drug evidence seized from vehicle in which he was traveling as a passenger.
