District court may order restitution for future lost income for three-month-old victim of voluntary manslaughter
RESTITUTION United States v. Serawop, No. 06-4022, ___ F.3d ___ (10th Cir. Oct. 25, 2007)(Utah). Appeal of restitution order imposed under Mandatory Victims’ Restitution Act (MVRA) at 18 U.S.C. § 3663A. HELD: MVRA permits district court to order restitution for future lost income for victim of voluntary manslaughter, even where victim is only three months old. MVRA refers to “income lost,” not “net income lost.” Therefore, restitution for entire amount of lost income, without deduction for victim’s personal consumption, is appropriate.
