Acceptance of guns as payment for drugs constitutes possession of firearm in furtherance of drug trafficking crime
STATUTORY CONSTRUCTION United States v. Luke-Sanchez, No. 06-4141, ___ F.3d ___ (10th Cir. Apr. 17, 2007)(Utah). Appeal of conviction for possession of firearm in furtherance of drug trafficking crime in violation of 18 U.S.C. § 924(c). HELD: Trading drugs for firearms furthers drug trafficking crime because drug trafficking crime would not have occurred but for defendant’s acceptance of handguns as payment. Therefore, nexus between drugs and guns used to pay for them is sufficient, to meet 18 U.S.C. § 924(c)’s prohibition against possession of firearm “in furtherance of” drug trafficking crime.
