Solicitation to commit burglary of dwelling is crime of violence for sentencing purposes
SENTENCING United States v. Cornelio-Pena, No. 04-3478, ___ F.3d ___ (10th Cir. Jan. 30, 2006)(Kansas). Appeal of sentence for illegal reentry to United States after deportation in violation of 8 U.S.C. § 1326(a). HELD: Solicitation of offense that otherwise meets definition of crime of violence is also crime of violence under sentence enhancement provisions of U.S.S.G. § 2L1.2. Therefore, because burglary of dwelling is crime of violence, solicitation to commit burglary of dwelling is also crime of violence for sentencing purposes under U.S.S.G. § 2L1.2.
